At A Glance

• Services that are offered by sellers on LittleJobShop are called "Jobs".
• It is free to join LittleJobShop. You can use LittleJobShop only once you have joined.
• LittleJobShop jobs are offered at fixed prices of $5, $10, $15, or $20.
• You may not make any offers to pay, or accept any kind of payment outside of LittleJobShop.com. All orders must be made through LittleJobShop.com. Users in breech of this WILL BE banned from using LittleJobShop.com.
  

Seller Specific Terms

• Each time you sell a job and successfully deliver it to the buyer, your account balance will be credited with the Nett revenue as detailed below.
• The Nett revenue will vary - depending on the price of your job - $5 job = $4 Nett, $10 job = $8 Nett, $15 job = $12 Nett, or $20 job = $16 Nett.
• Buyers pay LittleJobShop for any orders in advanced, when ordered.
• Once the order is successfully completed, LittleJobShop will accredit your balance.
• Each order advances through various stages and funds are available to withdraw once they have been cleared.
• You may withdraw your revenues via a PayPal account that you choose.
• If for some reason your order is cancelled, the revenues will be returned to the buyer.
• Seller and job ratings are determined by the positive or negative feedback from your buyer/client, as well as by order cancellation and late delivery.

Handling Orders

• The seller will receive an email when someone buys the job.
• As a seller, you must meet the job delivery deadline specified when creating it. Failing to do this, will enable the buyer to cancel. Should it be cancelled it will negatively affect your seller rating.
• If the buyer and seller reach a mutual agreement to cancel the job, it can be done so without any effect on the seller's ratings.
• Unanswered mutual cancellation requests will be automatically accepted after 48 hours.
• A Seller may cancel an order at any given moment. However, cancelling orders has a negative effect on a seller's rating. (The exception is mutual agreement to cancel.)

Work Delivery & Communications

• When receiving any files from a member, you are responsible for scanning these files for any viruses, Trojans or any other unauthorised programs that may be embedded. LittleJobShop will not be responsible for any damage that may occur on your system from infections.
• Sellers must use LittleJobShop functionality to deliver proof of work. You can find this in the menu item when logged in under inbox.
• When you have delivered all the work, the buyer has three days to respond to you. Once that time has expired the job will be marked as completed.

Withdrawing Money Earned...

• To withdraw your available revenue, you will need to have a valid PayPal account setup (You do this via your profile page). You should make sure that your PayPal is setup to receive incoming payments. Once we send a PayPal payment it is irreversible.
• Revenues can only been withdrawn from LittleJobShop after a clearance period of 14 days. This is done for security reasons.
• When you withdraw via PayPal, it will pay to remember that they charge you $1 to do so. So feel free to withdraw WHATEVER balance amount you like - but remember, the more you withdraw in one hit, the less the fee is - its all relative... Withdraw $2 LESS your $1 PayPal fee and you Nett $1 that's a 50% fee. Withdraw $50 LESS your $1 PayPal fee, you Nett $49 and only a 2% fee... but hey - it's up to you!
• Careful when you withdraw. Make sure you have entered the correct PayPal email in your profile. PayPal fees cannot be undone and we cannot reverse the payment once it has been committed to PayPal's system.

Buyer Specific Terms

Ordering Jobs

• Once you order a job, you will be required to pay for it immediately. You can either pay by PayPal or credit card (via PayPal). Once the payment is successfully received, your order will be created.
• If you have a balance at LittleJobShop.com of the job value you are ordering or greater, the funds will be taken from your balance and the job will be ordered.
• All payments to members must be made through LittleJobShop. If you are found to be making payments outside of our site, you account will be banned.
• ANY attempt to reverse a payment through PayPal or any financial institution will result in termination of your LittleJobShop user account.
• Always work our unresolved issues with your seller through the messaging facility on the site. If you are unable to resolve any issue, you can Contact us. If you cannot settle any issue directly between buyer and seller, we will make a ruling on the issue and our decision is FINAL. If we are required to settle a dispute, we charge a 20% fee of the total job value to do so. Example $20 job in dispute, we settle dispute at a fee of $4 and return the balance. For us to settle a dispute, we MUST be contacted within 10 days of the job being ordered.

General Terms & Conditions

Protecting Our Users

• Sellers' and buyers' identity are hidden for the privacy of all users. You must NOT request anyone's email address, Skype, msn or any other kind of communication between the two parties. Failing to respect this term will result in a ban of your account, and the loss of any funds you have in LittleJobShop.
• If you wish to send a message or file to the other party, it must be done via the inbuilt messaging system in LittleJobShop.com.
• If you post, send, or take part in any adult or illegal activity, your account WILL be banned AND you will forfeit any amount in your balance.
• Violation of LittleJobShop.com Terms of Service may get your account permanently disabled.

• If your account is disabled and you have credit on your balance the following terms will be in effect; If YOU disable your account, you may withdraw your balance within a period of 30 to 90 days from the date you disabled it. If WE disabled your account LittleJobShop.com reserves the right to delete the funds from you account if you are found to be in breach of these terms and conditions.
• LittleJobShop.com reserves the right to place any account on hold, or to permanently block it. If we do so you will be notified, and you will not be able to buy or sell any jobs.
• LittleJobShop may make changes to the terms and conditions at any time without notification to its members. It is the responsibility of users to check the terms and conditions via this page.
• You understand and agree that if you use LittleJobShop after the date on which the Terms & Conditions have changed, LittleJobShop will treat your use as acceptance of the updated Terms & Conditions.

Disputes

• Always try to work our unresolved issues with your seller through the email facility on the site. If you are unable to resolve it, you can Contact us. If you cannot settle any issue directly between buyer and seller, we will make a ruling on the issue and our decision is FINAL. If we are required to settle a dispute, we charge a 20% fee of the total job value to do so. Example $20 job in dispute, we settle dispute at a fee of $4 and return the balance. ($20 less the fee charged to seller at time of sale/purchase of $4 LESS the $4 dispute fee = $12 refund) For us to settle a dispute, we MUST be contacted within 10 days of the job being ordered.
• LittleJobShop will not refund payments made for cancelled orders back to PayPal due to the high fees to do so. Refunds are made to the buyer's balance and are made available for future purchases on LittleJobShop.

The following Terms and Conditions exist for the benefit of LittleJobShop.com and its members. LittleJobShop.com, at its sole discretion, reserves the right to terminate the account of any member caught in violation of any Terms and Conditions without notice.

1. Illegal activity. Members may not present LittleJobShop.com promotions on any page, newsgroup, email or any distribution method that is regarded objectionable by LittleJobShop.com, its Internet Service Providers, or otherwise considered unlawful according to any controlling legal authority. This includes, but is not limited to, pornography, computer viruses, prostitution, obscenity or Spam. If in doubt email us for clarification. Normal promotion via online or offline media is permissible other than as stated in this clause.

2. Third-Party Liability. LittleJobShop.com will in no way be liable for the actions of third parties that may, in any way, cause members harm.

3. Terms and Conditions. LittleJobShop.com reserves the right to update, modify, add or change the terms and conditions without notice.

4. The membership of the user can be canceled anytime by the administrator without giving any reason. Most usually this will be for breach of terms and conditions.

5. Any member acting in an unethical or unprofessional manner may be removed without refund at the sole discretion of LittleJobShop.com with all future commissions or payments being forfeited.

6. Membership Cancellation - Membership at LittleJobShop.com is voluntary and therefore may be canceled at any time by the member. LittleJobShop.com will only cancel/terminate a membership if it is deemed that the member is operating in conflict with LittleJobShop.com terms and conditions.

7. Cancellation/Termination of membership. Any membership that is canceled/terminated will forfeit all benefits and privileges associated with LittleJobShop.com. Any positions held in participating Programs owned by LittleJobShop.com will also be forfeited and ownership will be reassigned to LittleJobShop.com.

8. Relationship. A member is neither an employee nor an independent contractor of LittleJobShop.com.

9. Disputes. Agreements shall be interpreted under the laws of Australia.

10. Private Information. LittleJobShop.com will never provide personal information about its members to third parties without the consent of the member unless required by law.

11. Copyright Material. All branding, logos and graphics contained within LittleJobShop.com are copyright use; distribution or copying of such content is expressly prohibited. LittleJobShop.com provides members with approved material for marketing within the members area.

12. Damaging Intent. Any Member who engages in chat, email, postings or any other medium, content that is deemed damaging to LittleJobShop.com and or its members will be terminated from LittleJobShop.com. Depending on seriousness, LittleJobShop.com may deem it appropriate to exercise legal action.

13. SPAM. LittleJobShop.com strictly prohibits the use of SPAM. This enforcement is at the sole discretion of LittleJobShop.com and for the benefit of all its members. Members proven to be participating in such activities will have their memberships canceled.

14. Referral Commissions, Bonuses, Competitions or Giveaways. You understand and accept that any payment offered by LittleJobShop.com relating to Referral Commissions, Bonuses, Competitions or Giveaways are offered as an extra to any job or service sold via the site. LittleJobShop.com does everything possible to ensure accurate delivery of such payments. We will not however be held accountable for any discrepancy that may arise. All bonuses and additional payments will be credited to your account on or around the 10th day of the month following the month such bonus was earned. As all payments listed are considered a bonus, they are not to be relied upon as income, but instead a "frequent shopper" or "member extra" bonus. Any reference to possible payments that may be made under any bonus or incentive program offered by LittleJobShop.com are for illustrative purposes only. They do not indicate what you can or will earn. All such reference is merely to show you what MAY be possible. Each user should treat bonuses as exactly that - something extra to say "thanks for using LittleJobShop.com".

15. Contact Information. It is the responsibility of members to keep their personal records up to date at the members area. LittleJobShop.com will not be responsible for communication error due to incorrect or out of date contact information. Continued failed attempts to make contact with you may result in the termination of your membership.

16. Tax. You, the member, are responsible for any and all taxes payable in you resident domicile or jurisdiction, for any income you receive either from LittleJobShop.com or any program promoted via the LittleJobShop.com program.

Use of the Site

You understand that, except for information, products or services clearly identified as being supplied by LittleJobShop.com, LittleJobShop.com does not operate, control or endorse any information, products or services on the Internet in any way.

Except for LittleJobShop.com - identified information, products or services, all information, products and services offered through the Site or on the Internet generally are offered by third parties that are not affiliated with LittleJobShop.com.

You also understand that LittleJobShop.com cannot and does not guarantee or warrant that files available for downloading through the Site will be free of infection or viruses, worms, Trojans or other code that manifest contaminating or destructive properties.

You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.

YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SITE AND THE INTERNET. EVEN IF LITTLEJOBSHOP.COM OR ITS AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR (II) ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN THE SERVICE AND/OR MATERIALS OR INFORMATION DOWNLOADED THROUGH THE SERVICE.

When you access a non-LittleJobShop.com web site, please understand that it is independent from LittleJobShop.com, and that LittleJobShop.com has no control over the content on that web site. In addition, a link to a LittleJobShop.com web site does not mean that LittleJobShop.com endorses or accepts any responsibility for the content, or the use, of such web site.

Indemnification.

You agree to indemnify, defend and hold harmless LittleJobShop.com, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to the Service from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing the Service.

Third Party Rights.

The provisions of paragraphs "Use of the Service", and "Indemnification" are for the benefit of LittleJobShop.com and its officers, directors, employees, agents, licensors, suppliers, and any third party information providers to the Service. Each of these individuals or entities shall have the right to assert and enforce those provisions directly against you on its own behalf.

Ownership and Limitations (The necessary legal stuff)

When the work of a job is delivered, unless clearly stated otherwise in the job description text, the buyer is granted all intellectual property rights, including but not limited to, copyrights for the work delivered from the seller, and the seller waives any and all moral rights therein.

For the sake of clarity, where it is custom created work (such as art work, design work, report generation etc.), the delivered service shall be the exclusive property of buyer.

The seller expressly agrees to assign to buyer the copyright in any delivered services, and the seller agrees that unless he/she indicated otherwise in the job description, once the order is completed the seller assigns along with it to the buyer, to the fullest extent possible under the law, all of its right, title and interest, if any, in and to the delivered service and waives any and all moral rights in connection therewith.

The sellers further asserts that whatever information he received from the buyer, which is not public domain, shall not be used for any purpose whatsoever other than for the delivery of the work to the buyer.

By offering a service, the seller indicates that they have sufficient permissions to provide, sell or resell the service that they offer on LittleJobShop.com. Should it be found that this is not the case, the seller will be liable to any action legally entered into by any party as a result of their misconduct.
